Petitioner was ordered deported for his criminal record. No country would accept him and Cambodia did not have a repatriation treaty. He challenged his detention indefinitely as unconstitutional. The Supreme Court held that habeas petitions are available for claims by aliens that from a final removal order, the post-removal-period detention statute, read in light of the Constitution's demands, implicitly limits an alien's detention to a period reasonably necessary to bring about that alien's removal from the United States, and does not permit indefinite detention, and the Circuit Court applied a standard which improperly required petitioner to show there was no likelihood of acceptance.
